Distance sales agreement

1. Parties

1.1. Seller / service provider

This agreement refers to the seller as “Blaxn”.

1.2. Buyer / user

Any natural or legal person who registers on Blaxn.com and purchases services. Referred to as “User”.

2. Subject

This agreement governs the rights and obligations of the parties regarding the online website builder service purchased by the User on Blaxn.com, delivered electronically.

The service consists solely of digital content and digital infrastructure.

3. Service description

Blaxn.com is a platform that enables users to create promotional websites online.

The process is as follows:

  • The user registers on the platform.
  • Gains access to the website builder panel.
  • Builds the site by filling in logo, about text, corporate pages, product/service pages, blog and basic SEO.
  • Blaxn’s professional standard theme is used.
  • Brand colour palette can be chosen by the user.

Blaxn does not provide custom software development; the system runs on a standard theme.

4. Plans

Plan selection and payment are made via the user panel. Listed fees are indicative; the final amount is shown at checkout.

4.1. Plan 1 – Subdomain publishing (one-time)

  • The site is published at a path under blaxn.com (e.g. blaxn.com/yourname).
  • Full BLAXN panel features within the plan scope.
  • List price: USD 197.64 one-time (gross, taxes included). Billing currency follows checkout; for users in Türkiye, amounts may be converted to TRY using CBRT Forex Selling rates.
  • Publishing is activated after successful payment.

4.2. Plan 2 – Custom domain package (one-time)

  • Includes Plan 1 scope.
  • Source files (HTML, CSS, JS, assets) can be downloaded as ZIP from the panel.
  • The user manages hosting, domain and SSL and uploads files to their own server.
  • List price: USD 404.29 one-time (gross, taxes included). Currency and amount are shown at checkout (TRY/EUR/GBP/USD; Türkiye: CBRT Forex Selling).

5. Payment

  • Payments are collected via a secure payment provider.
  • List prices are stated in USD; charges may be settled in TRY, EUR, GBP or USD depending on location.
  • Services requiring payment are not activated until payment is completed.
  • Blaxn is not liable for failures of the payment infrastructure.

6. Withdrawal and refunds

The service is digital content performed electronically without physical delivery.

Under Turkish consumer law (including Law No. 6502 and related regulations on distance contracts), once the User consents to immediate performance and delivery of the digital service has begun, the right of withdrawal may not apply.

Therefore:

  • No refund after purchase once the service is activated.
  • No refund for published digital content.
  • No refund after source files have been delivered (Plan 2).

7. User obligations

  • The user is responsible for all content entered.
  • The user agrees not to upload content that infringes copyright or the law.
  • The user is responsible for accuracy of domain, hosting and FTP details.
  • The user agrees not to infringe third-party rights.

Blaxn is not liable for legal issues arising from user content.

8. Intellectual property

Blaxn platform software, system and standard theme belong to Blaxn.

Content created by the user belongs to the user.

Plan 2 source files are licensed for the user’s use; resale or redistribution of Blaxn infrastructure is prohibited.

9. Suspension

Blaxn may suspend service for illegal content, threats to security, non-payment or misuse.

10. Force majeure

Blaxn is not liable for events beyond reasonable control (disasters, war, cyber attacks, infrastructure outages, etc.).

11. Disputes

For consumer transactions, consumer arbitration committees and consumer courts at the User’s residence or Blaxn’s place of business have jurisdiction under Turkish law.

For commercial transactions, courts and enforcement offices in Konya, Türkiye have jurisdiction.

12. Entry into effect

By registering and completing payment, the User declares that they have read, understood and accepted this agreement electronically.

The agreement enters into force on the date of electronic acceptance.
